New Image™ is committed to providing quality products and services to you. This Data Privacy Policy outlines how data is collected, used, and protects personal data is protected, in alignment with the Data Protection Act, 2012 (Act 843) and ensuring compliance with data subjects' rights.

• Right to be informed: Data subjects must be informed about how their data is collected, used, and protected. 

• Right of access: Data subjects have the right to access their personal data.

• Right to rectification: Data subjects can request the correction of inaccurate data.

• Right to erasure (right to be forgotten): Data subjects can request the deletion of their data under certain conditions. 

• Right to restrict processing: Data subjects can request that the processing of their data be restricted. 

• Right to data portability: Data subjects can request the transfer of their data to another organization. 

• Right to object to processing: Data subjects can object to the processing of their data under certain conditions. 

• Right to complain: Data subjects have the right to lodge a complaint with the Data Protection Authority. 

Definitions

• Personal Data: Any information relating to an identified or identifiable individual.

• Sensitive Personal Data: Includes biometric data, health information, and other high-risk personal details.

• Data Controller: Previously referred to as "Data User," this entity determines the purposes and means of processing personal data.

• Data Processor: A party processing data on behalf of a New Image.

• Personal Data Breach: Any unauthorised access, disclosure, loss, or misuse of personal data.

Scope of Application

This policy applies to all entities collecting and processing personal data of individuals within Ghana. It also extends to data processors operating under a data controller’s authority.

Information We Collect

This Personal Information is obtained in many ways including (but not limited to) via our websites, social media, by telephone, email, mail and when you submit an application form to become a New Image™ Member. It can also be collected from third parties, for example where it is provided with your consent or where an application is made in joint names. It includes but is not limited to:

• Contact Information: Address, email address, and phone numbers.

• Financial Information: Bank account details and credit card information for processing payments.

• Transaction Information: Purchase history and product preferences.

• Technical Information: IP addresses, browser type, and access times collected through our website. This includes cookies (strictly necessary, performance cookies, functionality cookies, targeting cookies or advertising cookies. )

How We Collect Information

We collect personal information through various means, including:

• Direct Interactions: When you register as a Representative, place an order, or contact us for support.

• Automated Technologies: Through cookies and similar tracking technologies on our website.

• Third Parties: From affiliated partners and public databases, where permitted by law.

Use of Personal Information

We collect your Personal Information for the primary purpose of providing our services to you, and the marketing of our products and services. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. Purposes include, but are not limited to:

• Performance of a contract: this is when the processing of your personal information is necessary to perform our obligations under the member terms and conditions.

• Legal obligation: this is when we are required to process your personal information to comply with a legal obligation, such as keeping records for tax purposes or providing information to a public body or law enforcement agency.

• Legitimate interests: we will process information about you where it is in our legitimate interest in running a lawful business to do so to further the business, so long as it doesn’t outweigh your interests. Examples of legitimate interests are To offer information and/or services to individuals who visit our website or offer information about employment opportunities.

• To prevent fraud or criminal activity and to safeguard our IT systems.

• To customize individuals’ online experience and improve the performance usability and effectiveness of New Image™’s online presence.

• To conduct, and to analyze, our marketing activities.

• To exercise our fundamental rights in Ghana including our freedom to conduct a business and right to property.

• Your consent: we will ask you for specific permission to process some of your personal information, and we will only process your personal information in this way if you agree to us doing so. 

Disclosure/ Security/ Integrity of Personal Information

To help manage your membership, personal information, including your name, customer number, contact details and purchase history are disclosed to your direct sponsor and your upline. The same applies if your direct sponsor or upline resides outside Ghana. To the best of our ability, access to your personal information is limited to those who have a need to know. Those individuals who have access to the data are required to maintain the confidentiality of such information.

Your Personal Information is stored in a manner that reasonably protects it from misuse and loss and from unauthorized access, modification, disclosure, or destruction.  When your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your Personal Information.

We may share personal information with:

• Service Providers: Third-party vendors assisting in operations, such as payment processing and shipping.

• Affiliated Entities: Within our corporate family for business purposes.

• Legal Authorities: When required by law or to protect our legal interests.
